By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
2. Use License
a. Permission is granted to view the materials & information on The Kitty Card web site (www.showyourkitty.com) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
1. modify or copy the materials;
2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
3. attempt to decompile or reverse engineer any software contained on The Kitty Card web site;
4. remove any copyright or other proprietary notations from the materials; or
5. transfer the materials to another person or “mirror” the materials on any other server.
b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Kitty Card at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer
The materials on The Kitty Card web site are provided “as is”. The Kitty Card makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, The Kitty Card does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
4. Limitations
In no event shall The Kitty Card or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on The Kitty Card Internet site, even if The Kitty Card or a The Kitty Card authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Revisions and Errata
The materials appearing on The Kitty Card web site could include technical, typographical, or photographic errors. The Kitty Card does not warrant that any of the materials on its web site are accurate, complete, or current. The Kitty Card may make changes to the materials contained on its web site at any time without notice. The Kitty Card does not, however, make any commitment to update the materials.

The Kitty Card has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by The Kitty Card of the site. Use of any such linked web site is at the user’s own risk.

The Kitty Card may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
8. Governing Law
Any claim relating to The Kitty Card web site shall be governed by the laws of the Province of British Columbia without regard to its conflict of law provisions.

The Kitty Card Terms of Service and Use
IMPORTANT: By purchasing The Kitty Card (“Kitty Card”), you agree to and accept the following terms and conditions set out below.
1. Eligibility
Any individual who is 18 years or older is eligible to purchase the card. If you are under 18 years old, you must receive consent from your parent or guardian and The Kitty Card reserves the right to limit the availability of The Kitty Card.
2. Use
Each order for a Kitty Card is for a single cardholder, unless otherwise specified therein. Sharing of your Kitty Card is not permitted. The Kitty Card is non-transferable and may only be used by the person whose name is signed on it. For use of your Kitty Card at a participating merchant you must show your Kitty Card to the participating merchant prior to payment. A merchant has the right to deny a discount if you do not present your Kitty Card prior to payment. Merchants may reserve the right to ask for personal identification to verify you are the rightful cardholder. The Kitty Card and participating merchants are independent contractors. The Kitty Card is not liable for any products or services provided by these merchants.
3. Membership Benefits
Your Kitty Card entitles you to all of the offers and benefits set out on our web site. The descriptions of offers displayed have been approved by the relevant merchant. Merchants are encouraged to update their offers monthly. The offers are subject to change and availability and some restrictions may apply. It is recommended that you check the full details of each offer on the web site to ensure its availability and all of the terms and conditions of that offer. The Kitty Card can only be used at the branches of the stores listed on the web site of The Kitty Card.
The Kitty Card reserves the right to change, update or remove any of the offers made by merchants. Merchants are responsible for providing you with the services, products and benefits you select. The Kitty Card will not be responsible to communicate with merchants on your behalf, you are to contact the merchant directly. Merchants may impose their own terms and conditions and you are required to comply with these. When ordering or booking a product or service by telephone, it is essential that you inform the merchant that you have a Kitty Card and may be asked to give their card details and show your valid membership card upon payment. When making purchases with merchants, you will be required to show your valid membership card and may be asked to show valid identification.
4. Expiration of the Card
The 2010 Kitty Card Membership will expire on December 31st, 2010. The Kitty Card reserves the right to terminate your Kitty Card Membership at any time if it is determined that you have violated any of the Terms and Conditions set out herein. Registered Kitty Card Members will be notified by email prior to the expiration of the 2011 Kitty Card Membership and given instructions on how to purchase a 2011 Kitty Card Membership.
5. Refunds
Refunds will offered within 7 days of purchase if the card has not been used and is in its original package. To request a refund, send your un-used Kitty Card to 1201-550 Pacific Street, Vancouver, BC, V6Z 3G2. You must include your online order confirmation printed out with REFUND REQUEST written at the top of the page. Refunds will be issued electronically on which credit card the originally purchase was made for the full purchase price minus shipping costs. Refund credits will be applied within 5 business days from when the returned card is received by The Kitty Card.
6. Lost Cards
If your Kitty Card is lost or stolen, you will be entitled to one free replacement within the outlined membership year. For any additional lost of stolen Kitty Cards throughout the same membership year, The Kitty Card shall charge a replacement fee of $10. Notwithstanding anything herein, all replacement cards, including those that have been replaced at no additional charge will be subject to a nominal shipping and handling charge. You can report lost or stolen cards to info@showyourkitty.ca.
7. Changes to Offers or Merchants
Offers made available by merchants of The Kitty Card are subject to change and availability and some restrictions may apply. The Kitty Card reserves the right in its sole discretion to change the offers and or participating merchants. In addition, participating merchants are encouraged to change their offers each month and may elect to do so. The Kitty Card will make commercially reasonable efforts to make appropriate updates to its web site to reflect offer and/or merchant changes.
8. Merchants and The Kitty Card are Independent Contractors
The Kitty Card is not liable for any products or services provided by or through any merchant participating in The Kitty Card Program and for any error, omission or inaccuracy in advertising material or for any liability resulting directly or indirectly from a product or service provided by any merchant or other third party in connection with The Kitty Card Program.
9. Applicable Law and Jurisdiction
These Terms of Service and Use are governed by the law of British Columbia. The provisions of the “Privacy Policy” shall apply at all times.
